DUI Second Offense

A person with a Second Driving Under the Influence Offense is, in most if not all cases, subjected to jail time (usually 90 days to 12 months), community service (usually 30 days), a considerable fine ($600 - $1,000), longer terms of license restriction (up to three years), and a lengthier alcohol and drug education program. The person may also be required to attend Alcoholic Anonymous meetings. If the authority sees fit, the installation of an ignition device or the impounding of the offenders vehicle may be ordered.

If license restrictions are imposed, an offender typically has to go through some sort of DUI School to get their license back. The schooling has become a lot more involved in most states. The offender may have to go through an assessment interview with a professional counselor before their license can be returned. The professional counselor will ask questions to access the extent of the offenders drinking problem and then recommend a course of action. In some states, the counselor can adjudicate the offender into an Alcoholics Anonymous treatment program. The offender does not have to follow the treatment options suggested by their counselor, but in order to get their license back, they must submit to the options provided.

With a second offense, a professional counselor can demand that the offender spend lengthier time in the Alcoholics Anonymous treatment program. The counselor can suggest 90 meetings in 90 days, 28 days at a residential treatment center, detoxification, or other forms of medical treatment. All of the steps provided by the professional counselor must be met before the offender can have their license returned to them. In some states, a re-issuance fee may be charged for the new license.

The driver is also categorized as a repeat offender at this point.
