Drug Cultivation
Drug cultivation laws make it illegal to grow, produce, and possess certain plants or other naturally occurring elements used in the production of unlawful controlled substances such as marijuana. These laws also make it illegal to produce unlawful controlled substances such as cocaine, LSD, and Ecstasy, which require the use of chemicals and laboratory equipment to manufacture.
Cultivation is considered one of the more serious drug crimes and is prosecuted severely. Cultivation is usually charged as a felony offense. A person cultivating 5 or more ounces of heroin would be eligible for 10 years in prison because it is considered a distribution drug crime. When charging a person with cultivation, law enforcement will probably look at the following factors to determine an appropriate sentence: prior similar convictions, all prior convictions, if the offender is currently on probation or parole, attitude of community in relation to this type of crime, media attention, and aggravating circumstances. State and federal cultivation laws and punishments vary by jurisdiction.
Punishments for cultivation include, but are not limited to: fines, imprisonment, probation, house arrest, community service, drug testing, registration as a narcotics offender, loss of drivers license, and forced rehabilitation.
