Drug manufacturing laws make it illegal to grow, produce, and possess certain plants or other naturally occurring elements used in the production of unlawful controlled substances such as marijuana, cannabis, hashish or opium. These laws also make it illegal to produce unlawful controlled substances such as cocaine, LSD, crack cocaine, meth, PCP, morphine, steroids, Methadone and Ecstasy, which require the use of chemicals and laboratory equipment to manufacture.
When charging a person with drug manufacturing, law enforcement will probably look at the following factors to determine an appropriate sentence: prior similar convictions, all prior convictions, if the offender is currently on probation or parole, attitude of community in relation to this type of crime, media attention, and aggravating circumstances.
Manufacturing, delivering, or possessing with the intent to deliver a controlled substance is a crime with harsh penalties. A first time offender under possession with intent to deliver 100 grams to 5 kilograms of heroin will receive a mandatory minimum sentence of 5 years in prison, but the sentence can be as high as 40 years.
Common punishments for drug manufacturing include, but are not limited to: fines, imprisonment, probation, house arrest, community service, drug testing, registration as a narcotics offender, loss of drivers license, and forced rehabilitation.
