Failure to Register
Under the Adam Walsh Child Protection and Safety Act 2006, states must maintain statewide sex offender registries. All criminal sexual offenses involving a minor (a person under the legal age of consent) are covered under this Act, which involves 3 tiers. The third tier includes felony offenses comparable to or more severe than aggravated sexual abuse. The second tier includes felony crimes such as sex trafficking and child pornography. The first tier includes all other lesser sex offenses.
Sex offenders must register, and keep their registry current, in their state of residence, school, and work. They must also initially register in their state of conviction. Initial registration is required before imprisonment, and if no prison sentence is given, the offender must register within 3 business days of being sentenced. Sex offenders must submit their name and social security number. They must also submit their home, school, and work addresses, license plate number, and any other information required by the Attorney General. Tier one offenders must register for 15 years, tier two offenders have to register for 25 years, and tier three offenders must register for life.
Failure to register or to provide updates to the registry will result in a prison term of up to 10 years.
