$500,000 in Damages Sought by Tasered Officer

Gilbert Police Find Fellow Officer Asleep at the Wheel

After being arrested in a DUI case last year, Phoenix Officer Seth Castillo filed a claim against the Gilbert Police department for a whopping $500,000 in damages, citing excessive force and violation of civil rights. Castillo was shot with a taser when he reportedly dropped his hands during the incident. According to the report, police discovered Castillo "slumped over" behind the wheel of his vehicle, found parked in a Gilbert intersection and blocking potential traffic. After several minutes spent awakening him, he was ordered out of his car and told to place his hands on the vehicle where they could be seen.

It was at this point that the Phoenix officer is alleged to have "dropped his hands". This action alarmed the arresting policeman, who thought he might be reaching for a weapon, causing him to discharge his taser, subduing Castillo.The phoenix internal affairs office launched an investigation into Castillo's activity, removing him to a desk job for its duration. Lab results from his blood test showed that Castillo had a blood alcohol content level of .17 percent, over twice the legal limit. Prosecutors in Gilbert are charging him with a DUI and failure to obey a police officer.

Castillo Battles Back

After the investigation ended, Castillo decided to take the fight to Gilbert. He filed a claim of $500,000 against the department, as compensation for the alleged "egregious and extremely outrageous" behavior of the arresting officer. Though he neither admitted nor denied having driven drunk, Castillo claims the tasering caused emotional distress and damage to his reputation. In addition, he claims the arrest violated his 4th Amendment right to protection from unlawful search and seizure.
