Georgia’s New Smash and Grab Act

By Law Offices of Matthew T. McNally  Jan. 30, 2012 3:59p

In the summer of 2010, the Georgia legislature passed new laws against theft crimes commonly referred to as "smash and grab." These types of thefts involve smashing windows, doors, or display cases to quickly grab merchandise and then making a fast exit. Such a crime is more complicated than shoplifting or simple theft because it combines breaking and entering, theft of merchandise, as well as criminal damage to property. Thefts of this nature are committed by juveniles and adults both, often as part of a gang effort. Retail outlets such as Macy's and other merchants have been especially victimized by smash and grab thieves throughout the Atlanta metropolitan area, costing them millions of dollars in losses and damage.

The new laws increase penalties against thieves committing this type of theft. The laws define this type of theft as entering a store without authority with the intent to commit theft and causing more than $500 in damage. An adult convicted of this crime faces a mandatory two years in jail. If an adult solicits a minor to do a smash and grab, the adult faces a prison term of one to 5 years.
