The man was arrested and charged with possession, transportation, and sale of a controlled substance, possession of a smoking and drug injection device, possession of a billy club, being under the influence of a controlled substance while driving, and violation of a probation warrant.

Drug paraphernalia is defined under California's Health and Safety Code 11364 as a pipe or "device, contrivance, instrument, or paraphernalia used for unlawfully injecting or smoking a controlled substance." You can be convicted of a violation of this law if you have control over and knew about paraphernalia used for illegal drugs. Possession of drug paraphernalia under this law is charged as a misdemeanor carrying a jail sentence of up to six months and a fine of up to $1,000. Possession, transportation, and sale of methamphetamine also violate the Health and Safety Code. Similar substances are also included under this law, including PCP, GHB (gamma hydroxybutyric acid), anabolic steroids, and ketamine.
