Western New York Man Charged under New Gun Law

A 33 year-old man from the western part of the state of New York has been charged with the unlawful sale of assault weapons in violation of New York's tough new gun laws. The defendant apparently sold the weapons to an undercover state policeman posing as a felon, a violation of the New York Secure Ammunition and Firearms Enforcement Act (SAFE Act). The new law was passed in January in the state in response to the tragic school shootings which occurred in December 2012 at an elementary school in Newtown, Connecticut. Per the new law, it is illegal to sell such weapons to a convicted felon. The law also prohibits the sale of high-capacity magazines, mandates gun registration and mental health checks on those who wish to purchase such weapons. Besides the assault weapons, the undercover sale also included ammunition and magazines.

A conviction of the above crime under the new laws carries penalties of up to seven years in a state prison. The new law also provides stronger regulation of the sales of ammunition, which are tracked by the state. Those who sell ammunition in New York must register with state police and must conduct a background check on purchasers as well as report sales to the police. Internet sales of ammunition are also prohibited under the new law; those purchasing rounds over the internet must finalize the transaction in a face-to-face meeting with a gun dealer who conducts the required background check before finalizing the sale.
