Hit and Run, What to Expect if Charged

If you have been charged with a hit and run accident you need to get legal advice immediately from a criminal defense lawyer. Per California law, anyone involved in a car accident has to identify themselves to the other party involved no matter who was at fault. If injuries were sustained, this becomes even more important.

Hit and run laws are very strict in California and if you are convicted, you may be sentenced to jail as well as have to pay heavy monetary fines up to $10,000. If the hit and run accident resulted in a death or serious injury, you may be sentenced to prison or have to pay additional fines and restitution. The severity of the accident and whether you have ever been convicted of a crime before will determine if you will be charged with a misdemeanor or felony.

If you happen to run into an unattended vehicle or other property which is stationary, per the law, you are to make a reasonable effort to try to identify the owner and let them know what occurred. You could, as an example, take down the vehicle license number if you hit a parked car or leave a note for someone at the scene of the accident with your contact information on it.  These would be considered reasonable efforts.

 

If a person gets injured after a collision, it is your responsibility to help that person by calling for emergency help and reporting the accident to local law enforcement officials. Failing to do the above can leave one open to a felony hit and run charge.
