Sexting: An Internet/Computer Crime

By Virginia L. Landry  Jul. 25, 2011 9:56a

Internet crime has increased in recent years; another type of crime that now fits into this category is called "sexting." This activity involves the transmission of nude images or other suggestive material through text messages. These messages can be text-based or image-based and can be sent over cell phones, smart phones or computers. If a nude, partially nude, or sexually suggestive image of a minor is transmitted through any of these devices, it can lead to criminal charges and enters the realm of child pornography.

Child pornography laws are some of the harshest felonies on the law books and the penalties can be serious as both the sender and the receiver can be subject to penalties. The approaches to the subject of sexting vary within different jurisdictions and some areas are stricter than others. If you have been charged with this offense, it is advisable to get help from an Orange County criminal defense attorney who knows the local laws.

The Laws are Unclear

The laws relating to sexting are unclear. In some areas, legislatures and local authorities prefer harsh penalties and include the violations underneath child pornography laws. In other jurisdictions, lawmakers are trying to decriminalize sexting when done by minors and where they distribute the material to other minors. Probation or other methods of diversion are used in some areas to place emphasis on education for offending minors.
