No Charges Filed in False Kidnapping Report

By Martinian & Associates  Nov. 20, 2012 4:22p

The Sheriff's Department received a call around 5:00 pm last Friday from an individual who claimed to have seen a child get kidnapped from a playground. The caller said they observed two people at the park wrap a young child in a blanket and then place him or her in a car and drive away. Officers began investigating the kidnapping claim by following leads on a description of the car and a partial license plate number that was provided by the caller. The investigation led to a south central Los Angles home where deputies were able to trace the car to. Deputies arrived at the location and discovered that the 5-year-old child was safe and sound with his/her parents. The two people seen wrapping the child up in a blanket at the park were the child's grandparents. They explained that the child was cold and that is why they used the blanket. They then drove the child to the child's parent's house. The matter was then dropped by law enforcement and no charges were filed. Have you been unfairly charged with a criminal offense? Kidnapping Can Be a Federal Offense

"Kidnapping" is considered any instance where an individual is moved from a location against their will or without the consent of a legal parent or guardian; it includes instances where force, violence or threats of violence are used. Kidnapping is a felony and certain circumstances may make the alleged offense a federal crime. Circumstances such as assault, injury, the age of the individual (kidnapping a minor under the age of 14 increases the charges), can significantly enhance the penalties if a conviction is obtained. Sentencing for this crime can include anywhere from three to 11 years in prison, thousands in fines, lengthy probation and other penalties. If the FBI or other government agencies are involved then harsh federal charges may be assessed which could result in a federal prison sentence.
