Three Women Dead after Suspected DUI Accident

By The Law Office of Barney B. Gibbs  Feb. 20, 2013 11:39a

Friends and family gathered at a candle light vigil recently held in Anaheim in memoriam of three women that were killed in a pedestrian accident. The three women were crossing South Western Avenue around 11:00 at night after attending a baby shower. As they crossed the wide four lane street they were struck by a car. The driver, a 40-year-old male, remained at the scene as paramedics were called. All three women had suffered severe injuries and one of the women was pronounced dead at the scene. The other two women were transported to area hospitals in critical condition.

Unfortunately, the other two women succumbed to their injuries and both died at the hospital. Police took the driver of the vehicle involved into custody on suspicion of driving under the influence. Reports do not indicate what substance (drugs or alcohol) the driver is suspected of being allegedly under the influence of or what tests were done to determine intoxication. If the man is found to have been DUI then he could be facing serious DUI manslaughter and/or vehicular homicide charges. Make sure your rights are protected if you are accused of a DUI offense by getting the help of criminal defense lawyer well versed in DUI law.

What to Expect in a DUI Stop

Police or other law enforcement officials must have probable cause for pulling a driver over at any time. This reason can range from subtle things such as observing the car to swerve slightly out of its lane to more obvious infractions of traffic laws such as speeding. Once the stop has occurred, the officer will most likely speak with the driver briefly and then ask him or her to perform a field sobriety test if the officer suspects intoxication. The test may be the use of a portable breathalyzer machine or a physical coordination test such as the one leg stand, walk and turn or horizontal gaze nystagmus test. Based on the drivers performance on these tests, the officer may determine that there is evidence of driving under the influence and then take the driver into custody.
