Manslaughter is a legal term which refers to the killing of another human being, in a manner which is less serious than murder.
When a suspect is facing murder charges, the killing itself is allegedly containing the element of malicious intent to kill or, malice aforethought. The difference between murder and manslaughter all comes down to the “intention” of the individual who caused the death to the other person. Did they plan the killing? Was their whole intention to murder the other individual or was it self defense or a killing that happened in the heat of the moment?
When a prosecutor is faced with the choice of whether to charge a suspect with murder or manslaughter, they will take into account whether or not, the person knew that their actions would result in death or, if an eventual death was their “plan.” If there appeared to be an entirely lack of plan or intention to kill, the person will most likely be charged with either voluntary manslaughter or involuntary manslaughter. If you are presently in the situation where you are facing murder or manslaughter charges, you must seek representation from an experienced criminal defense attorney who will protect you and your legal rights.
