Repeat Offender in New York Gets Prison Sentence for DWI

Last December, a 51 year-old man received a prison sentence for his 12th drunk driving arrest since 1981. He was sentenced in a Nassau County, New York court to nearly six years in prison, the maximum amount for this offense. The prison term will be his third time behind bars for drunk driving. He was arrested last year for hitting an elderly couple who were crossing the street in Oceanside. His blood alcohol concentration (BAC) at the time of the accident measured .20 which is more than twice the legal limit. He later pleaded guilty to aggravated driving while intoxicated, unauthorized use of a vehicle, aggravated unlicensed operation of a vehicle, assault, reckless driving, and reckless endangerment.

Aggravated driving while intoxicated may be charged in cases where the driver has caused an accident in which someone was injured or killed or where property damage occurred. You also may be charged with this offense if your BAC was extremely high, if you were found transporting a minor while intoxicated, if you were driving with a suspended or revoked license, or if you have previous DWI convictions. An aggravated DWI conviction will result in harsher penalties than a standard DWI.

Subsequent DWI convictions, as in the case above, also result in increasingly harsher penalties. For instance, a third and subsequent convictions in New Jersey may be punished with fines of up to $1,000 and jail sentences of up to 180 days as well as a 10-year license suspension.
