California’s Proposition 36 in Drug Crimes

Under the regulations of Prop 36, those convicted of a nonviolent drug offense may be eligible for an alternative sentencing program which places them in a drug rehabilitation program instead of behind bars in a jail or prison. Those who may be eligible are those convicted of using, possessing, or transporting drugs listed in the U.S. Controlled Substances Act for their own personal use. These drugs include such substances as cocaine, heroin, marijuana, methamphetamines, and unauthorized prescription drugs such as Vicodin and codeine. Restrictions are placed on who may qualify for a diversion program. For instance, cultivation of marijuana is an offense for which a Prop 36 diversion program is NOT allowed.
