Domestic violence crimes are common criminal charges in Texas as well as throughout the nation. These types of crimes are very serious legal matters for the accused as they are vigorously prosecuted. A domestic violence misdemeanor conviction can result in up to one year behind bars, fines and court costs, and a prohibition against owning firearms for up to five years. Another consequence may be a protective order prohibiting the convicted offender from making any contact with the victim at home, work, school, or habitual places that the victim visits. Such an order may be effective for up to two years with further legal consequences if violated. The offender may also be required to complete a court-ordered batterer's program and pay the victim's attorney fees as well. A second domestic violence crime will generally be charged as a felony with even harsher consequences.

The Texas Council on Family Violence reports that in 2008 more than 193,000 domestic violence incidents were reported in the state and that 136 women were killed by intimate partners. The agency also reported that their surveys show that 74 percent of all Texans have either experienced some form of domestic violence themselves or have relatives or friends who have experienced it. 31 percent of those surveyed had been seriously abused either physically or sexually while 47 percent had been victimized by some form of domestic abuse, either physical, sexual, verbal, or through forced isolation during their lifetime.
