Ex-Sacramento Police Officer Lied about DUIsBy Tower Legal Group

A police officer who formerly worked for the Sacramento Police Department pleaded no contest in court last week in regards to charges of falsifying DUI reports and lying at DMV administrative hearings in regards to DUIs. The officer, B.M. who is 27 years old, faces penalties of up to five years in a state prison on four felony counts although he could be given only five years probation. His sentencing is scheduled for April 27, 2013. The officer originally faced 34 counts associated with lying about DUIs. He was placed under investigation after defense attorneys in DUI cases in 2010 reported that his evidence in such cases did not add up. As a result of the discrepancies found in his reports, 79 DUI cases that he was involved in had to be scrapped by the District Attorney's Office.
According to prosecutors, the officer lied in his police reports as well as in affidavits he submitted to the courts and the DMV. In some incidences, he also failed to follow proper procedure on field sobriety tests as well as lied about drivers whom he said were unwilling to do such tests. According to the police officer's defense attorney, he simply made mistakes on legitimate DUI cases in his enthusiasm to get DUI offenders off the streets.
