In Florida, DUI, or driving under the influence, is a criminal offense with severe consequences for a defendant. Driving under the influence can include impaired abilities due to alcohol or both prescription and illegal drugs. When a law enforcement officer detains a driver under suspicion of driving under the influence, there are several tests that they employ to determine if a driver is impaired, and therefore a hazard on the road and to other drivers or pedestrians. The first types of test usually employed are the breath or blood test. Both tests determine through different means if a driver has an illegal BAC, or blood alcohol concentration. The legal BAC limit is .08 percent, but if another test is employed and the driver fails they can still be considered to be driving under the influence with impaired abilities.
The other types of tests are known as field sobriety tests, which test the mental and physical capabilities of a driver. Under normal circumstances any person is supposed to be able to perform these tests with ease. There are certain situations however, when these tests are ineffective due to improper administering of the test or medical situations, which render the test invalid.
