Drug Possession Could Be Third Strike

By Law Office Kinsell, Zadel & Whitaker  Sep. 7, 2011 3:35p

An incident that started as a simple bicycle law violation turns out to be serious trouble for a local man. Deputies spotted JF riding a bike at night without the front and back lights installed as required by law. When the deputies attempted to speak with him about this, he attempted to escape the officers on foot. The chase ended when one of the deputies warned him that a taser gun would be used on him if he didn't stop. JF immediately went to the ground and was taken into custody by the officers. When he was searched, a loaded gun was found in his pocket as well as over a dozen individual packets of marijuana.

The Florida man is a convicted felon with two previous charges for major drug crimes. He now faces serious drug and weapons charges including marijuana possession with intent to sell, illegal possession of a concealed firearm by a convicted felon, and resisting arrest. They seemed to have let him off on the bicycle law violation. The man could be facing a third strike and life in prison if the charges are graded as felony offenses.
