In Westminster, Colorado a school bus driver has been arrested and charged with DUI. The 58 year-old driver, B. C., reportedly had a blood alcohol concentration (BAC) level that was close to three times the legal limit as measured on a chemical test. He was driving a bus that was carrying a Westminster high school football team after the team had completed a football game. Passengers on the bus stated that the driver drove erratically during the 10 mile trip back to Mountain Range High School where he also hit a parked truck. A breathalyzer test conducted by police showed his BAC at .213 percent. The legal limit in Colorado is .08 percent.
The driver has since been charged with an array of criminal counts, including 37 counts of reckless endangerment child abuse for each of the student players, driving while under the influence of alcohol, and four counts of reckless endangerment of the four coaches onboard. No injuries were reported of any of the bus passengers. The driver was jailed on $4,000 bail.
Reckless endangerment is charged when a person's conduct creates a "substantial and unjustifiable" risk of bodily injury. In charges involving drunk or drug-impaired driving, reckless endangerment charges may accompany a DUI charge when the impaired driver operates his vehicle with a child in the car.
