| Domestic Violence – One of the Most Fabricated Charges |
| Posted By Criminal Defense News |
 |
Charged with
domestic violence? If so, it’s important to contact an attorney right away. Domestic violence is a highly fabricated crime, and unfortunately, law enforcement officials often arrest people for domestic violence with little to no evidence backing up the accuser's claim. In some states, it doesn’t take much more than the accuser’s word for the police to come down to someone’s house and arrest them for domestic violence. Often times, an angry, resentful, or upset spouse will make a domestic violence accusation as a form of revenge. Other times a couple may be verbally fighting, but one person embellishes the truth by saying the fight escalated into a physical fight. Sometimes it is children who make false claims of domestic violence, whether for attention or because they are angry at their parent.
The point is, emotions can easily get mixed up in an already tumultuous situation, and when they do it can lead to a huge headache for the person accused. In addition to arrest, a restraining order may also be issued and your ability to see and spend time with your loved ones could be compromised. When faced with a domestic violence accusation, it’s in your best interest to speak with a knowledgeable and experienced
domestic violence defense attorney right away. A lawyer who has experience defending people against domestic violence charges will know how to proceed forward, and can help you fight your charges to avoid a conviction that would undoubtedly compromise your personal life, compromise your relationship with your family, and jeopardize your rights and freedom.

| Types of Domestic Violence |
| Posted By Criminal Defense News |
 |
Domestic violence constitutes more than just physical assault and battery. There are a number of unlawful acts that can lead to domestic violence charges, such as:
-
Emotional and psychological abuse: yelling, screaming, threatening, belittling, or taking any other type of action to chip away at the victim’s self-esteem. Trying to control the victim’s every move is also considered emotional/psychological abuse.
-
Financial and economic abuse: controlling the victim by controlling his or her access to money or ability to earn money. This might include prohibiting the victim from working or withholding money from the victim.
-
Sexual abuse: forcing the victim to engage in unwanted, unsafe, or degrading sexual acts against their will. One of the most common forms of sexual abuse is spouse rape. Many people think it’s not considered rape when sex is between spouses. However, if one of the spouses doesn’t want to have sex, but the other spouse forces or coerces it, it is considered rape.
-
Child abuse & neglect: physical, emotional, or sexual abuse committed against a child. Neglecting a child’s basic needs is also a form of domestic violence.
-
Elder abuse & neglect: physical, emotional, sexual, or economic abuse against an elderly parent, grandparent, or relative. Neglecting an elderly parent or relative is also a form of domestic violence.
If you have been accused of domestic violence, it’s important to speak with an experienced
domestic violence defense lawyer immediately. Domestic violence can easily be fabricated, and the police don’t need much evidence to bring a domestic violence suspect into custody. Protect yourself and your rights by hiring an attorney to represent your case and defend you against the accusations made against you!

| Grandmother Pleads No Contest to Neglecting 3-Year-Old Who Died from Drug Overdose |
| Posted By Criminal Defense News |
 |
A Wisconsin woman has been convicted of neglecting her 3-year-old granddaughter who died from a prescription drug overdose.
April M. Walker, 40, faced criminal charges after her granddaughter, 3-year-old Amaya Marie Walker, died after consuming both oxycodone and Valium.
According to the complaint, Walker failed to seek help for Amaya for nearly six hours. The complaint says Walker notified staff and residents at the YWCA homeless shelter where she and Amaya lived that she was going to take the girl to the emergency room. Instead, Walker first drove two YWCA residents to a Job Center, and then went to her mother's house to watch "Young and the Restless." It wasn't until the show was over that she finally called a nurse to ask about Amaya's condition. Even after speaking to a nurse, it wasn't until Walker picked up a friend, who noticed that Amaya wasn't breathing, that 911 was called.
Amaya died the next day. She had six times the therapeutic range for oxycodone in her system, in addition to the Valium. A doctor later testified that she could have been saved had she been taken to the hospital right away.
As part of a plea agreement, Walker pleaded no contest. District Attorney Brian Blanchard said he would ask for no more than 10 years in prison.
Walker's attorney said she is acknowledging her responsibility for the offense and her actions by pleading no contest.
Walker, who has a history of prescription drug abuse, said she doesn't use drugs anymore, but that she was taking medication for anxiety and depression to cope with her grief.
Amaya's mother was in prison at the time of her death.
It's unclear how Amaya got access to the drugs.

| Mother Pleads Guilty to Neglecting Daughter Who Was Beaten to Death |
| Posted By Criminal Defense News |
 |
A mother in Indianapolis has pleaded guilty to child neglect.
Rachel Goodman was charged with neglect of a dependant after authorities claim she stood by and watched as her boyfriend beat her 14-month-old daughter to death.
Prosecutors argued that Goodman should have come to her daughter's aid as she witnessed her boyfriend, Tayuan Chism, whip her daughter Lilliana at least 15 times with a belt. Instead, Goodman stood by and did nothing.
According to police, Goodman initially said she left the room because she couldn't stand to watch, but the prosecution said there were a number of things she could have done to save her daughter's life.
"She could have called 911. She could have gotten (other people) to intervene. She could have taken Lilliana and run from the apartment. She didn't do any of those things," said Marion County Deputy Prosecutor Denise Robinson.
Goodman's sentencing has been scheduled for February 26. If convicted, she could be sentenced to 30 years in prison, but because she has no prior felony convictions, her sentence could be suspended.
Goodman is expected to testify against Chism, who has been charged with
murder, when he goes to trail February 1.

| Supreme Court Refuses to Appeal D.C. Sniper's Execution |
| Posted By Criminal Defense News |
 |
Attempts to get the Supreme Court to block the execution of John Allen Muhammad, also known as the "D.C. Sniper," have failed.
Muhammad was convicted of capital
murder and
terrorism charges for killing 10 people and wounding three others over the course of three weeks in 2002. He also left threatening written and verbal messages that demanded $10 million for the killings to stop. He is scheduled for execution Tuesday evening at a state prison in Virginia.
Muhammad has maintained his innocence throughout two trials, however, prosecutors say Muhammad's shooting rampage was fueled by grudges against the Army and a desire to kill his ex wife. In fact, prosecutors believe the shooting spree was intended to cover up his real goal, which was to kill his wife and gain custody of their children.
Defense attorneys, who may or may not file an appeal due to lack of grounds, are claiming Muhammad is mentally ill and suffers from post-traumatic stress disorder from his service in the Persian Gulf War.
As of now, the only thing that could save Muhammad from the death penalty is if Virginia Governor Tim Kaine were to grant a clemency petition, however, Kaine has already said he is not likely to grant such a petition.
Lee Boyd Malvo, who acted as an accomplice to Muhammad and was only 17 years old when the shootings took place, was sentenced to life in prison. His attorneys argued that he was brainwashed by Muhammad.

| Group Raises Money for Domestic Violence Awareness |
| Posted By Criminal Defense News |
 |
In Charleston, a group by the name of YWCA tried to raise money today for domestic violence awareness. The group, which is comprised of women who wore their absolute finest to the fundraiser, tries to raise money for a good cause each year. The women scheduled this year's event with the hope of raising $100,000.
The fundraiser took place at the Sunrise Museum and the theme was "Girls in Pearls". Every woman that attended wore black and white to coincide with the theme. The YWCA says that the money they raised today will go toward counseling services that would have been otherwise eliminated due to drastic funding cuts in the state this year.
When asked about rasing money for domestic violence awareness, YWCA Co-Chair Paige Payne said, "11 years ago some ladies got together and saw the need in our community. Saw domestic violence was a real problem here in West Virginia and I think the first year they raised about two or three thousand dollars." She also said that, "Last year we got $100,000 back to the charity and we should pass that this year even with the economy we are amazed with the outpouring of support from the community."
This year, the group scheduled a featured speaker by the name of Star Hogan - a survivor or domestic violence.

| California Man Admits to Killing Wife With an Axe |

An 85-year-old California man was arrested after he allegedly killed his 55-year-old wife with an axe.
According to Sheriff Deputy Keith Ho, James Che Ming Lu called the Los Angeles County Sheriff's Department Temple Station early Sunday morning to report that he had just killed his wife.
Investigators said that a domestic dispute had occurred that eventually led to Lu striking his wife with an axe.
When deputies arrived they found Lu's wife with multiple stab wounds. She was pronounced dead at the scene.
Lu was then taken into police custody, where he is currently being held on $1 million bail.
After searching the home, detectives confirmed that there was an axe in the East Pasadena home, and that it was likely the murder weapon.
According to Lu's son, who lived with his parents and pulled the axe out of his father's hands while he attacked his mother, Lu worked as a carpenter, which is why he had the axe.

| Mother Charged in Death of Twin Daughters |
| Posted By Criminal Defense News |

A Houston woman is facing criminal charges in connection with the death of her 18-month-old twin daughters.
According to Harris County prosecutors, Lavera Moore left her daughters alone in their duplex. Before leaving the home to go to the store, Moore turned on two oven stove burners for heat. When Moore returned home that night, the duplex was on fire. The two girls died in the blaze.
A Harris County grand jury indicted Moore on two counts of criminally negligent homicide. If convicted, Moore could face six months to two years in jail and up to $10,000 in fines.
Friends and neighbors say the incident was an unfortunate, tragic accident.
"The home did not have central heat. It was an older home. She was using the stove to keep the house warm on a very cold winter night," said community activist Quanell X. "It was an accident. It was just a bad lapse in judgment."
Henry Carroll, the girls' father and Moore's boyfriend, said, "It as tragic accident. I'm just here to show my support and our family is destroyed."
According to Quanell, Moore "is in a bad mental state of mind, as any mother would be who lost her children. She's doing her best to cope with family support."
Moore was bonded out of jail several hours after surrendering herself.

| Singer Chris Brown Facing Felony Battery Charges |
| Posted By Criminal Defense News |
 |
Singer Chris Brown is facing felony domestic violence charges stemming from an incident that occurred early Sunday morning.
According to a statement from the Los Angeles Police Department, "detectives investigating the alleged
domestic violence felony battery booked him for criminal threats."
The police statement said Brown and a woman were in a vehicle near Hancock Park when they began arguing. When Brown stopped his car, the woman got out of the vehicle and the argument escalated. After receiving a 911 call on Sunday around 12:30 a.m., officers found the woman at the scene of the incident, but Brown was already gone, the LAPD said.
An article from CNN states that police have not identified the alleged victim, who they said had "suffered visible injuries and identified Brown as her attacker."
Police say the incident is being treated as a possible felony
battery case.
Both Brown and his girlfriend, singer Rihanna, were scheduled to appear and perform at yesterday's Grammy Awards, but both canceled their performance. No reason has been given for the cancellation.
Hours before the incident, Brown and Rihanna were seen together Saturday night at a pre-Grammys dinner at the Beverly Hills Hilton, about five miles from the where the argument allegedly broke out.
Brown posted a $50,000 bond and was released by police Sunday night. A court date has been set for March 5.

| 19 Year Old Pleads Guilty to Child Abuse Charges in Colorado |
| Posted By Criminal Defense News |
 |
The Greeley Tribune of Colorado is reporting that at the very last minute, a deal was struck between prosecutors and the defendant of the so-called "Mortal Combat" case, which led to the death of a 7 year old girl this past year.
This past Monday, approximately one year after the death of little Zoe Garcia, 19 year old Lamar Roberts pled guilty to
child abuse resulting in the girl's death. He is facing between 16-48 years in prison for his crime. The second child abuse charge was dropped due to the agreement Roberts made with prosecutors.
Just a half-hour before attorneys were to confirm Roberts' January trial, a deal was reached between the defense and prosecution team. Roberts is expected to be sentenced on January 16, 2009.
The case was alluded to as the "Mortal Combat" case because Roberts and Zoe's sister, Heather Trujillo, were alleged to have been imitating the violent video game on the night of Zoe's death, December 6, 2007. Trujillo recently pled guilty and was sentenced to 6 years in the youthful offenders system.
After the death of Garcia, the two defendants were arrested, but their accounts of the events leading up to Zoe's death continually differed. Trujillo told investigators that she was wrestling with her sister when her sister suddenly passed out. She said that her sister woke up and that they put her into bed. 15 minutes after putting the girl to bed, Trujillo reports that they went to check up on her, but she was no longer breathing.
However, after exhaustive questioning by police, Trujillo said that Roberts kicked Garcia, but he did not know how hard he had kicked her because he had been drinking at the time of the incident. Affidavits revealed that Roberts told the girl's mother, Dana Trujillo, that he had picked the young girl up and body slammed her. He also said that at one point, the girl fell to the ground, and she stopped breathing.
An autopsy was performed on Zoe and revealed that she had more than 20 bruises all over her body, a broken wrist, bleeding and swelling in her brain along with internal bleeding. The state coroner listed the cause of death as "blunt force injuries."

| Massachusetts Man Found Guilty of Child Abuse |
| Posted By Criminal Defense News |
 |
Today, in Springfield, Massachusetts, a man was found guilty of
child abuse after he was accused of allowing the traumatic beating of his stepdaughter. Reports indicate that his stepdaughter sustained a severe brain injury after she was savagely beaten.
The jurors presiding over the case found Jason Strickland guilty of five of the six charges related to the beating that occurred in 2005. The victim was 11 year old Haleigh Poutre. Prosecutors allege that Strickland and his wife, Holli, participated in physical abuse that left the young girl in a coma and on life support.
Prior to their deliberations, the jurors asked Hampden Superior Court Judge, Judd Carhart, if they had to believe that Strickland was present when the girl suffered the catastrophic brain injury. The judge said that they did not have to believe that Strickland was present, but did have to believe that an "ordinary person" would know that leaving Haleigh with her mother would lead to serious injury of the girl or a real risk of injury. The jury deliberated for a few hours and then delivered the "guilty" verdict.
34 year old Strickland, an auto mechanic, claimed that he never physically abused Haleigh. He said that he believed his wife when she said that Haleigh's injuries were self-inflicted. Injuries included burns, bruises and cuts. The jury decided that they believed Strickland had not abused Haleigh himself, but was negligent and allowed the injuries to occur.
Strickland was charged with six counts of assault and battery for the numerous injures the 11 year old suffered in September 2005 and from prior beatings from a bat, his foot, a stick and his open hand. He was convicted of 2 counts of
assault and
battery on a child, two counts of assault and battery with a dangerous weapon and one count of assault and battery.
His sentencing is expected to occur on December 11th.
Haleigh was on life support for several months before child welfare officials received permission from the court to remove her feeding tube. However, prior to the removal of her feeding tube, she began to show signs of improvement. The state received criticism for acting too quickly and not looking out for Haleigh's best interest. Haleigh is now 14 and lives in a Boston rehabilitation hospital where she is able to perform simple tasks, including feeding herself and writing her own name.

| 8 More Indictments in Texas FLDS Polygamist Case |
| Posted By Criminal Defense News |
 |
This Wednesday, a grand jury in West Texas handed down eight more indictments in the highly controversial FLDS case. The case's criminal investigation revolves around
child abuse allegations against members within the polygamist sect.
Currently, the leader of the sect, Warren Jeffs, remains jailed. Criminal charges have been brought against Jeffs and three other Fundamentalist Church of Jesus Christ members. The charges include eight felonies for aggravated
sexual assault, bigamy and tampering with physical evidence.
Members of FDLS have been under investigation by law enforcement since April 2008. In April, Texas Child Protective Services removed more than 400 children from the groups' Yearning For Zion Ranch, which is located in Eldorado.
Prior indictments of FDLS members occurred earlier this year. To date, 12 adults have been indicted in court for their actions and roles in the marriages of minor girls. The girls were removed from by CPS caseworkers because it was discovered that they were being groomed for illegal marriages. The removed children were returned to their parents, save for a few dozen which remain under the supervision of the court.
The names or the gender of the people indicted this past Wednesday have not been released to the public. However, their criminal charges have been made public. The first member has been indicted for conducting an unlawful marriage ceremony between an adult and a minor, the second was indicted for three counts of third-degree bigamy and the third was indicted for four felony charges: first-degree bigamy, second-degree bigamy, third-degree bigamy and tampering with physical evidence.
Jeffs is the fourth defendant in the case. He was indicted on Wednesday for a first-degree felony count of aggravated sexual assault. In addition, he was indicted in July for the sexual assault of a minor.

| Posted By Criminal Defense News |
 |
24 year old, Ian Alexander Murphy, was recently arrested by Baltimore County law enforcement and charged with
rape and
kidnapping. It is reported that Mr. Alexander committed the offenses on October 6, 2008 near Towson University.
The victim, a 21 year old woman, was unloading groceries outside a University building at around 1:00 A.M. While she was unloading her groceries, police say that Murphy forced the woman to walk several blocks to Knollwood Road, where he then pushed her behind some bushes and proceeded to
sexually assault her. He let her go after the attack.
Shortly after the devastating crime was committed, the woman called the Greater Baltimore Medical Center and reported what had happened to her. She was not able to give a full, detailed description of the man who assaulted her. However, the Baltimore County police department had received calls and reports from concerned locals about a young man. Police obtained a warrant for the offender this past Saturday while the University sent warning letters to students and the community.
Yesterday, Ian Alexander Murphy was charged with first degree rape, first degree
sex offense and kidnapping in court. He appeared before the court commissioner and was denied any form. Murphy is currently being held in the Baltimore County Detention Center and has a bail review scheduled for October 14th.

| Kentucky Mother Kills Self and Two Young Daughters |
| Posted By Criminal Defense News |
 |
A Louisville, Kentucky woman stabbed her two young daughters to death before taking her own life by shooting herself in the head.
Police have still not determined a motive as to why Hope Orwick, 35, stabbed her daughters, Emily Orwick, 9, and Lindsay Orwick, 8. Orwick had been raising the two girls as a single mother ever since her husband, Chad Orwick, committed suicide in 2005.
According to Louisville Metro Police Spokeswoman Alicia Smiley, the three bodies were discovered early Monday night when a family member stopped by the family's home.
Police have still not determined a motive for the killings. When police questioned friends and family of the victims, all seemed to be shocked by the news.
"She was just the mom you wanted supporting the school," said Wendy Anderson of Hope Orwick. Anderson, who is a counselor at the girls' elementary school and saw Hope Orwick just days before the killing, also said, "There were no signs. There was nothing that even looked odd."
Mechelle Rockey, the Orwick's neighbor whose own daughters often played with Lindsay and Emily, said the neighborhood children were distraught over the incident. "They were the sweetest little girls. They were as cute as a button," said Rockey. "They all played together."
Hope Orwick's uncle, David Stieren, told police that his family was still grieving and not ready to talk. "We're just so upset we can't talk about it right now," said Stieren.
Crisis counselors will be available starting Wednesday at Auburndale Elementary School where the girls attended school.
No legal action has been taken at this time.

| Ohio Sheriff Deputy Heads to Trial for Domestic Violence |
| Posted By Criminal Defense News |
 |
A Sheriff's deputy in Hamilton County, Ohio faces a jury trial next week on counts of
domestic violence, assault, and obstruction of official business. According the Hamilton County Court, the deputy, Nicholas Rauen, was charged on May 11 after authorities were called to his home for domestic violence.
Rauen is accused of attacking his wife in their home by throwing her on the bed, climbing on top of her, shaking her, and yelling at her. When another woman came into the home to check on the couple, Rauen allegedly "flipped out" and attacked her as well, throwing her to the floor, causing her to bruise her arm and elbow.
When authorities finally arrived at the home, Rauen kicked the door shut and locked it to try to prevent the authorities from entering his home. The authorities were able to eventually open the door with a spare key. Once inside, Rauen refused to show his hands until the authorities threatened to Taser him.
911 was notified of the incident by an anonymous caller, who has yet to identify himself or herself.
Rauen and his attorney, Steven Halper, insist the deputies that arrested him are at fault, and did not have probable cause for arrest. Halper said that both he and Rauen are hopeful that the matter will be resolved in court on Tuesday.
Rauen, who works as a correction officer for the Hamilton County Sheriff's Department, has continued to work since his arrest. If convicted of the charges, Rauen could face punishment ranging from reprimand to termination.

| Summer Of 2008 - The Safest In L.A. In The Past 40 Years |
| Posted By Criminal Defense News |
 |
According to the Daily News, the summer of 2008 was the safest summer since 1967 in Los Angeles. In the summer of 2008,
homicides fell to the lowest level since 40 years ago.
Historically, the summer months of June, July and August are violent times in Los Angles, CA. In prior years, homicides always exceeded 100 during the summer. However, 2008 marked the first time that summer killings fell below 100, with only 84 people killed citywide.
This year, L.A. County made progress that was far different from years past. Unlike 2002, where killings were at an all time high (174 homicides, making Los Angeles the homicide capital of the United States), 2008 marked a seemingly safe summer.
Police Chief William Bratton believes that the low homicide number results from collaboration with other police agencies and from police cracking down on both gang crimes and immigrants with illegal records. Chief Bratton states, "Unemployment is up, the economy is not good. A lot of the things that so-called experts predict make crime go up is not happening here," and "We have been building momentum over the last six years. I think it will continue to get better."
Chief William Bratton expects to see L.A.'s violent crime rate continue to decrease and expects that the violent crime rate will drop 5 percent by the end of the year. With continued police focus on gang crime prevention and aggressive crack downs on all types of gang related activity, Los Angeles will surely see more safe summers in the near future.

| Wife Tries to Take a Hit Out on Her Husband |
| Posted By Criminal Defense News |
 |
Recently, a wife by the name of Dalia Dippolito was placed on house arrest by a Florida judge after being accused of trying to take out a hit on her husband. Despite being caught, Dippolito and her attorney were able to convince a judge that she should be placed on house arrest instead of being held in prison. In addition to being placed on house arrest, 26 year old Dippolito was also ordered to pay a bond of $25,000.
At this time, the Dippolito is facing criminal charges for trying to hire a hit man to kill her husband. Palm Beach police say that the young wife has been charged with solicitation of first degree
murder. Dippolito has also been ordered to stay far away from her husband, 38 year old Michael Dippolito.
Police were able to tape conversations that Dippolito had with her would-be hit man. During conversations, the two plotted the murder of her husband. On the tape, Dippolita said that she was, "5,000 percent sure" that she wanted to move forward with the plans to kill her husband. She also provided a time and an alibi for the murder. After discussions, Dippolito gave the hit man (an undercover cop) $1,200 for a down payment.
When Michael Dipplito was asked about the hit on his life, he said that he was shocked that his wife wanted to have him killed. He then said, "I'd lay down in bed at night and I knew something was wrong."
