Man Sent to Prison for 2 Years Following Probation Violation

A man that violated his probation in December from a robbery conviction has been sentenced to two years in jail, though the sentence was handed down when the man pleaded guilty to assaulting a police officer, as reported by the Mankato Free Press.

When District Court Judge Kurt Johnson sentenced D.R. Jr., 45, he stipulated that he will serve one year – the sentence for assaulting an officer – at the same time as the other.

Originally D.R. Jr. was due to begin his jail time on January 2 on the robbery charge after a December 17 sentencing. That charge stemmed from his attempt to steal $50 from a convenience store customer on August 8.

His two-year sentence was stayed with the condition that he serves a year behind bars, be on probation for 5 years, refrain from alcohol and drug use, remain crime-free and submit to random drug testing.

However, on December 19, two days after his sentence was handed down, two police officers responded to a call of an intoxicated person at a restaurant and discovered D.R. Jr. – fallen from his bicycle, on his knees in snow and a bottle of vodka that he had dropped nearby.

As the officers came to his aid they noted that he smelled of alcohol and his speech was slurred. Officers assured D.R. Jr. that he was not in any trouble, but they wanted to move him into their squad car to make sure he was warm. They told D.R. Jr. that they were there to only help him.

They tried to walk him to his car, however, D.R. Jr. ended up almost doing "the splits", fell down and then blaming the officers for his poor footing. After that D.R. Jr. swore and became aggressive. As he was handcuffed he swung and kicked at the officers. One of the officers received two kicks to his legs after D.R. Jr. was in custody. Once taken to jail D.R. Jr. continued his tirade by calling one of the officers a derogatory name and threatening to kill him.

D.R. Jr. spent the weekend in jail. On Monday he went to court to answer to both of the charges. He pleaded guilty to felony fourth-degree assault and the violation of his parole.

Another violent incident, where D.R. Jr. was the victim, occurred when he was living in North Mankato. A young man, who was the son of a woman that D.R. Jr. was dating at the time, stabbed him at a duplex. D.R. Jr. reported the incident to the police and the teen was arrested.

In July of 2009 D.R. Jr. was arrested in Waterville on the suspicion of sexually assaulting teen girls in his apartment. Though felony charges of sexual assault were later dismissed, D.R. Jr. pleaded guilty to indecent exposure and contributing to the need for child protection services. He is now required by law to register as a sex offender.
