About Drunk Driving Charges

By Jowdy & Jowdy  Feb. 24, 2011 3:29p

Driving while intoxicated due to the consumption of alcohol or drugs is a crime punishable by heavy fines, probation, license suspension, and jail or even prison sentencing. In Connecticut, you can be arrested and charged with DWI or DUI if a law enforcement officer determines that your blood alcohol content (BAC) is above the legal limit of .08 percent. In drunk driving cases that involve accidents, injuries or fatalities you may face felony charges that could cause serious problems for your future. If you have been arrested or charged for DWI, DUI or drunk driving in Connecticut you should immediately contact a Danbury criminal defense attorney so that an effective defense can begin to be built by you and your attorney.

When a police officer suspects that a driver is intoxicated and operating their vehicle they will pull the driver over and look for any evidence that suggests intoxication including slurred speech, the smell of alcohol or open bottles sitting in the vehicle and asking the driver if they have been drinking. If an officer suspects that the driver is intoxicated they may ask them to perform field sobriety tests such as a breath test in order to establish probable cause for an arrest. While you are not required to perform field sobriety tests or answer questions such as "have you been drinking?," if you are arrested you will be required to submit to a breath test or other BAC test, which will determine if you are considered legally intoxicated at which point you could face criminal charges.
