New Laws Reduce Marijuana Possession Penalties

By Humphrey Law Offices  Jun. 19, 2012 9:48a

Governor Chafee recently approved a measure that effectively reduces penalties connected to possession of small amounts of marijuana. As of April 1st of 2013 it will no longer be a criminal act to be found in possession of up to one ounce of marijuana. The law states that the small amount of this drug possessed by an individual will be considered a civil violation (rather than a misdemeanor) punishable by a $150 fine. If, however, a person receives three violations within an 18-month period then they will be charged with a misdemeanor. At that point, the individual could be facing much more expensive fines as well as jail time. If you have been charged with a drug crime anywhere throughout the state then it is crucial that you talk to a Rhode Island criminal defense lawyer immediately.

Penalties for Drug Possession and Other Drug Crimes

Punishment for drug crimes, such as drug possession, in Rhode Island varies depending on which drug and the quantity allegedly in possession. Also taken into consideration at the time of sentencing (if a conviction is obtained) is the intent—was it for personal use or for sale? Simple drug possession charges can mean punishment of several years in prison, expensive fines, 100 hours of community service and mandatory substance abuse counseling. Possession of large amounts of marijuana (one to five kilograms or more) is a felony and may result in up to 50 years imprisonment and $500,000 in fines. Possession of a kilo or more of cocaine or heroin has especially harsh penalties which can include life imprisonment and $1,000,000 in fines.
