About 10 years ago a Sacramento man, S.J., was found guilty of breaking and entering and repeated sexual assault, including rape, of a 72-year-old woman. S.J. was found guilty in the original criminal court case. As it was his third felony conviction he was sentenced to 310 years in prison under California's Three-Strikes laws. U.S. Circuit Court of Appeals Ruling Overturned

The County District Attorney's Office as well as those at the state attorney general's office were stunned by the appeals court ruling and took the case to the U.S. Supreme Court. The Supreme Court reversed the ruling of the appeals court after reviewing the case and included the statement, "There was simply no basis for the 9^th Circuit to reach the opposite conclusion, particularly in such a dismissive manner." The appeals court then reinstated the original conviction in the case.
