Understanding Search and Seizures

For police who are investigating drug crimes of any kinds (whether manufacturingdistribution or trafficking), there is hardly a more important or important tool than that of search and seizure. Often, a vast majority of evidence used in a prosecutor's case comes from such a process, and they usually form the backbone of the legal offense used against the accused. If a search and seizure is later deemed as unreasonable, for example if a judge had not issued a warrant and circumstances did not justify the search without it, all evidence found will be thrown out under the Supreme Court's "exclusionary rule." All evidence found as a result will also be tossed as it is considered "fruit of the poisonous tree." While this does not necessarily mean your case will be dismissed, it does mean you do not have to defend evidence gotten through illegal ways.
